+5 Internets | i won a lawsuit against my school for booting me my junior year after i made a parody website in 1999 about the vice principal, but i had a disclaimer to prevent him from trying to push a personal lawsuit. the school district lost and didn't try to repeal a 2nd time to prevent it from becoming case law. free speech outside of school is not the school's business, only the people it is directed at. the principal himself could push civil stuff, and file a restraining order or something against the kid to prevent him from attending but any use of his power to punish him is a violation of the kid's first amendment rights. not that i agree with it; my website and lawsuit weren't just to be an asshole i was also lampooning the idea that i was legally protected while being an asshole. really though, if people weren't such morons the principal could have just talked to the kid's parents and they would have taken it down and punished the kid themselves. my parents BEGGED the schools to settle things without expulsion and let them punish me, and the school treated them like pigs. 20 years in the PTA and 3 generations at the school, and the school wouldn't even listen. we only went to court because they were such hardheaded assholes. |

+1 Internets | you missed the point. the point was that if you think someone has slandered you, you sue them and a court of law decides whether or not and how to punish the defendant. what you don't do is take the law into your own and hands and find a way to punish that person. the principal, rather than seek damages in a court of law, took justice into his own hands by abusing the power he happened to have over the defendant. libel outside of the school, in the childs own time, has absolutely nothing to do with the school. just like if i toilet paper a teachers house, i cannot be given a detention for it next time i show up to school. the correct course of action would be for the teacher to notify the police and seek an arrest for vandalism. see what i'm saying here?

+4 Internets | I just mistook what you were saying. No, the principal cannot punish the student for something outside of school. Although, I wonder what loopholes, if any, he could find if the kid did it on computers at school. Aside from what the principal did, the kid should be taught a lesson. Youth have no respect anymore. |
