| Thing is, all it's going to take is one of these companies to go "You know what? Fuck it, let's fight this thing all the way" and the people bringing the case will shit themselves. They're in it for the quick settlement, not Blactivizzard or Sony going all Phoenix Wright on them. |

The poor cannot afford to take a chance on paying the winner's fees so they would never bring a suit. Also, it punishes people for the law being one big gray orgy. Nothing is clear and you really don't know how a court is going to rule until after the case has had its day in court. Hell, look at recent Supreme Court decisions about proper complaints, they just reversed their own precedent! The American system basically decided it will deal with the frivolous crap so the least amount of people are economically barred from having their day in court as possible. (Of course lawyers and court fees are still ridiculous) Rayne, in these large lawsuits with several huge corporations, the majority of fees occur before you even go to trial. Discovery costs a massive amount for these kinds of cases. Not to mention, most of them already have their lawyers on the payroll. But ya, they won't settle, it is bad for business. | |

+18 Internets | Similar to the blackberry patent Settlement reached in BlackBerry patent case - BlackBerry Battle- msnbc.com Cliffs from a class where we talked about it briefly: Some guy patents the idea to have a way to gather information from one source on the fly, patent buying firm buys his patent, he dies, everyone forgets about the patent, In Motion creates blackberry, few years later the patent buying firm sues them for violating the patent. |

| when I lived in NYC I worked with Paltalk people... we were their ad firm. in my experience, the limits of ethics are generally tested by the marketers, but in this case we had to talk them out of many money making ideas that were too raw for public consumption. this is classic in perspective on the side, my GF worked for Madoff. Must be some kind of shiva vibe. |
