So it appears the chances of a Fallout MMO ever coming got a little closer to slim, and a little farther from none. Interplay apparently won an injunction from Bethesda, and are now allowed to continue working on V13. They are also filing a countersuit, claiming that Beth unfairly interfered with it's business, and are asking the court to basically restore their ownership of the Fallout IP.

Finally, they are releasing Project V13 concept art. Ironclad proof that development is well underway. Why else would they get someone to paint some pictures?

Injuctions usually only are granted when there is clear and obvious reason, such as the preliminary presentation shows overwhelming evidence. They didn't win anything, they simply managed to not be shut down entirely until the case is actually brought to court.

And unless they come up with 30 million bucks 8 months ago.. I don't see how this will go forward.

The absolute worst outcome at this point is Interplay actually winning. Letting Herve Caen wrest control over Fallout would be a disaster, not to mention that Fallout: New Vegas could be taken away from the people who actually made Fallout in the first place...

I didn't know that Obsidian got the rights to the next Fallout title, that's pretty cool.

As for the lawsuit, I don't think it's really about the 30 million, I think it's more about the rights to sell the old Fallout titles. And I doubt Interplay expects to get the Fallout IP back. It's probably just a tactic to angle for a settlement.

They could always just do a new IP if it is indeed for a new game and not just milking existing profit, it's not like the Fallout universe really has that much solid lore behind it; it's always been more the retro-futuristic feel of it and gameplay that defined the games imo.

Interplay did NOT win preliminary injunction hearing: NMA Fallout (at least not yet)

'You will not often hear from me, but as Interplay's in-house lawyer I feel the need to set the record straight here...

The Court has not ruled on Bethesda's Motion for Prelminary Injunction. A proposed order was filed with our Opposition to the Motion, but that is not the same as an Order of the Court. The hearing is weeks away. Interplay will issue an official statement if there is a material development that needs to be addressed. Please do not rely on rumor or speculation.

In the meantime, we all appreciate your enthusiasm and support.'

Someone over at NMA misunderstood, apparently.

The someone was the 'investor' (read: bought a stock or two of Interplay and gets sent copies of official letters and shit) and his biased Bethesda-hate filled ramblings.

Someone named frymuncher or something, I've seen him post at the Interplay forums and he is the epitome of tool.

According to NMA Interplay submitted some actual screen shots as evidence. Here is an example:



They look, well meh. But then again, these appear to made strictly to prove that the game is being worked on, and are not promotional. Still, I could have done something similar with Maya and a few weeks worth of spare time.

Captures the look of FO 1-2 than FO3 did imo. Almost looks like some of the same filters as TF2.

Yea that SS looks like its from 2003 not 2009, for a game that is years from complete (if it even exists) it really looks awful.

And I see NMA is just as bizzaro-world as always... man that place makes me wonder at the delusions of some people.
