Doesn't Sony or someone usually step in at this point and buy them out? The Fallout IP certainly has to be worth more than Vanguard and SOE snapped them right up.

The IP sure. But there is no game. That's a good 50 million right there.

Bethesda owns the IP, not Interplay. Interplay has absolutely no rights when it comes to the Fallout MMO IP, Bethesda can chose to pull it at anytime.

If Interplay makes the MMO they have to pay royalties to Bethesda because they would be using their IP.

The Fallout license and the Fallout MMO license were always seperate. Interplay had the MMO license and sold it to Bethesda for quick cash, but with a clause allowing them to license it back in order to make an mmo, in exchange for paying royalties.

Interplay sold the entire IP to Bethseda but retained the rights to produce an MMO. They have until 2010 to have a product shipped or they lose the license. Interplay owns nothing of Fallout any longer.

The Fallout name is owned by Bethesda. Therefore Interplay has no rights to the name.

Also, by April of 2009 they have to have 30million dollars of investment, or else it's curtains.

Interplay Releases 2007 Earnings; New Web Site Launch Imminent: Financial News - Yahoo! Finance

Quote:
First, management is working to secure funding for the development of a Massively Multiplayer Online Game (MMOG) based on the popular "Fallout" franchise. Interplay sold "Fallout" in 2007 while obtaining a license back, under certain conditions, to create and develop a "Fallout" MMOG.

At the same time, the company will leverage its portfolio of gaming properties by creating sequels to some of its most successful games, including Earthworm Jim, Dark Alliance, Descent, and MDK.

Instead of a Descent sequel, they need to just do a Descent MMO.. PVE too. EVE already has the PVP market.

Gamasutra - News - Bethesda Sues Interplay Over Use Of Fallout License

Looks like Interplay is about to kick the bucket. They have barely $16k USD in assets at this point.

Harsh. I guess all that legalese is standard, but it reads like kicking a man when he's down. R.I.P. Interplay

Looks like they were just trying to make some extra cash for the MMO by repackaging 1, 2 and Tactics but failed to go through Bethesda. Maybe they were trying to avoid getting pegged with royalties or something. Pretty big blunder and it appears it will cost them the company.

bethesda makes great games, ya the mod community is great too but a great mod community doesnt turn a pile of shit into gold all by itself, and bethesdas games lately have been gold.

Plus while i will admit morrowind was weak pre mod, oblivion was much better and fallout was pretty much a complete game pre-mods with few holes.. i mean fallout premods was pretty much a runaway for game of the year most places.

World building and quest design and story arc bethesda is one of the best we have ever seen... combat systems tend to be weak points... tho imo vats was a major step up and interesting take on fps alternatives in a rpg.

I dont feel bad for interplay at all, they were gonna shit over one of the enduring licenses in gaming with some cobbled together piece of shit... this is like if someone took the SW license away from george lucas before episode one, ya he made it in the first place but you can't say you woulda been sad to see someone stop him from fucking it up.

I would say that on those three points, Oblivion is among the WORST I have ever seen. Fallout 3 was a big improvement, but I would have zero faith whatsoever in Bethesda's ability to create a MMO given how completely inept they are at patching single player games.

Story may have been fairly weak in Obvlion, but the world was fantastic at the time. So many caves and dungeons and forts. I mean, it put some MMO world spaces to shame. And questing was fairly open-ended in parts as well.
