+2 Internets | Haha, I decided to do a little internet dectective snooping. Well, a guy named Hellpit posts on a lot of porn forums, but most significantly, a furry forum. Couldn't find anything else but that should give you some comfort that he is that much of a loser. |

| Why do you need hellpit's personal information to report him to the FBI? They have ALL the tools needed to find him. Go ahead and say he threatened to blow up a building or something in irc chat and get homeland security activated on his ass. |

+58 Internets | Former company I worked for had to report some guy for using stolen credit cards. Basically they had to refund everyone's money (lost their products) and were blown off by the FBI for the next year until they eventually just stopped worrying about it. |

| Assuming you are located in California, ...why not file a Pre-Suit Discovery action against Blizzard for the identification(name and address) of this individual? Blizzard's User Agreement provides a Choice of Law provision for California jurisdiction so it wouldn't require any large travel expense. Most states, including Illinois-where I practice, allow for a Pre-Suit Discovery procedure, ie., Supreme Court Rule 224 and Section 2-402 of the Code of Civil Procedure. The purpose being to identify "potential, but unknown" defendants in a civil suit. Happens all the time. In fact, I used the Illinois statute just the other day to identify a potential defendant's name, address, employment position, etc. My point is, you might have a civil cause of action against this individual under possibly two federal Telecommunications/Internet laws that would award you civil damages for the monetary injury you and your company has sustained. Therefore, pursuant to the Blizzard Privacy Policy, as well as State and Federal Pre-Suit Discovery statutes, you might have a basis for seeking this information. Blizzard's Policy provides for the release of this information under certain circumstances(arguments pro/con unknown); to wit, "We reserve the right to disclose your personal information as required by law or in special cases when we have reason to believe that disclosing such information is necessary to identify, contact, or bring legal action against you if you are violating the Terms of Service or Use Agreements for a Blizzard site or product, or may be causing injury to or interference (intentionally or unintentionally) with Blizzard's rights or property, other users of a Blizzard site or product, or anyone else who could be harmed by your activities." You probably don't want to expend the money for an attorney's service in this matter but it might be your only possibility. Of course, certain statutes do provide for the recovery of attorney fees if successful. I am unaware as to whether any applicable statutes would provide for same herein. Otherwise, contact your local District attorney and request his service in prosecuting this individual for telephone harassment. I have never researched the laws in this area, nor do I practice criminal law, but it seems to me that if someone is harassing you by telephone (ie., internet/wwweb) it would be in violation of several criminal harassment laws if his actions are intentional or reckless. (note: guesstimation on my part, just throwing out ideas) The point is, District Attorney's have the right to subpeona this information if relevant to the prosecution of a crime. Of course, you really don't know if it is him unless you have some form of an admission that he in fact is "ddos'ing" your servers. Did you, or will you, suffer some financial harm due to his actions? Are his actions a violation of your Terms and Conditions policy for all viewers/users of your internet sites/servers? Just thought I would throw some shit out there during my lunch hour to give you some ideas. Good luck my friend. Caveat: I practice in the areas of Employment/Labor Law and Insurance defense work (including medical malpractice), but not in the areas of law heretofore discussed.

| Ah, I see what Mero is saying. Basically, in a civil suit you can file against John Doe. You then enter the period before trial called discovery...basically where you establish and begin asserting the facts of your case, to be outlined in your bill of particulars (bullet point of facts). To get the name of this attacker, you'd probably need Hellpit's IP or something. You then ask the company, or ask a judge for a subpoena. I'm not really convinced of the feasibility of the action nor the cost-effectiveness of it, (how much money does this kid's parents have? can't get blood from a stone, y'know?) if you're really angry you could do the whole thing yourself probably, pro se. |

If it was my business he was doing this to, I'd do my best to see that he got a criminal record for it in the hope that he works in IT, and can then get to explain to every employer he interviews with for the rest of his life why he has a record for computer-related crimes.
