Doubt he will be charged. He was defending himself...

The only charge I could have seen was possession of an illegal weapon since it was sharpend. No idea what Maryland's laws are though... and given that they haven't filed any I doubt he will be.

Depends if Maryland has any sort of castle/home defense laws. In some places you could be charged in a situation like this, because you apparently have a duty to retreat from your own fucking house. Also depends if they can corroborate that the burglar actually attacked him, though the burglar being unarmed isn't going to help him at all.

Edit: Looks as though Maryland does have castle law built in to their self-defense stuff.

Guglielmi said the suspect had 29 prior convictions for crimes such as breaking and entering, and had been released Saturday from the Baltimore County Detention Center after he was arrested by county police in August 2008 for stealing a car in Baltimore. Rice was found guilty in December on one count of unauthorized removal of property, and he was sentenced to 18 months in prison.

Sounds like the burglar had this comming a long time ago.

This story will continue to give hope to everyone out there with a sword just waiting for some idiot to crawl in through a window.

And some of these home defense laws are just stupid. They basically require a guy to be raping your daughter while threatening her with a rocket launcher before you can act.

It means that he is pretty much allowed to use deadly force to defend his house and isnt obligated to try to flee before using deadly force.
