The argument was you can't sue the government if they didn't spy on you. And the government isn't telling people who they spy on, so the people who brought the case suspected they were being spied on and the ACLU initiated legal action for them? I guess it might be a difficult issue for a court to rule on.

Did all judges unanimously decide not to review the case?
