They don't need to amend shit. If it's 1 in 8, as long as there's 1 loot per 8 packs across ALL packs, then they are fine. Some schmo could get a box of boosters and get a loot item in every booster, while a ton of people could open boosters and not get any, and as long as it averages out to 1 every 8, it's not false advertisement.
Now, some CCG companies will say "1 special card per box of booster packs" and it's randomly placed in 1 of the 36 (or however many) booster packs....if it were advertised like that, and you bought a box, and there wasn't a special card...then you could get pissed.
Sucks tho that they can say certain states and Europe can't play....dunno bout the European part, but Wizards of the Coast with it's Magic: The Gathering CCG online doesn't have any limitations for states in the US.
