Legal work isn't to be rushed, and if they're taking it seriously, it'll be announced as its own component rather then pushed in a "lol, here's the EULA" format. When any company gets to the point where they are in alpha or beta in their project legality framework should be in place. It is a 100% must.
Hell, We had to get legal stuff worked out with uberguilds radio before we announced anything about it.
Even Kaos War had legal framework setup well before their demo.
I'm not taking part in any bashing here but putting it into perspective, once your project even starts development you have to get the legal side finished WELL before it is even announced.
