I really, really doubt FSS is going to enforce the NDA either. They don't have a legal leg to stand on since you are actually paying now for access to the beta, rather than being given it for free, especially since there is no mention at all of the NDA when you actually pay for your pre-order. So every single beta with an NDA on fileplanet is invalid also because you have to pay for it? lol...
It doesn't matter if you had to pre-order if you want a key. You still have to agree to an NDA if you want to use the pre-order key. Also the main point of NDAs is to protect their IP rights. As soon as there is no more NDA they lose their trade secret status on their project which means they lose a lot of rights under IP law.
