Mist isn't defending them. He's defending the laws that allow that type of stuff but also allow far more "socially acceptable" types of kinks or what have you, such as blowjobs, women with big breasts, or 2 hot women going at it.
I suppose while statistically someone who engages in such acts might be a more likely candidate to do such in real life, it's not a straight forward "if you do A, you must do B".
That being said, it's perfectly within Blizzard's rights to ban them from the game. And it wouldn't surprise me if they eventually do as such. This is afterall the company that renamed the Maine Coon because of some QQing morons and removed the "Kill two dwarves" song because it probably was seen as promoting drug use or what have you.
