This was a bug a really really long time ago. You were able to /petition the item and have it replaced wth a charged item back then. I am sure they will still do it on an old account. If you go to EQLive and search way back in the forums you might be able to find the bug posted there.
If its an item you can recharge like a gauss or a shrinking device id just blow it off, but if it was like a rare DA earing or something of that sort, I would keep petitioning over and over until they replaced it. They reppaced everyone elses, they should replace yours.
