There is no difference to him, the difference is whether the justice system perpetuates this cycle of punishment and repeat offenses, or actually attempts to rehabilitate the offenders and reduce the chance that this type of offense will occur again.
Some people will continue to break the law no matter what you do. There will always be those beyond the help of society. There are many, however, who are trapped in the cycle of repeated offenses and punishments because the system is so bent on punishing them that it never bothers to help guide them into a more productive, socially-acceptable lifestyle.
The trick is to create a system that can actually determine the difference, and act accordingly.
