uhh no? not unless when you go in for the test they make you aware that theyre going to turn over evidence to authorities in the case of a negative and fully aprise you of your legal rights.
samples of bodily fluids drawn/taken without permission outside of the context of a warrant, or an exception to the warrant requirement (none of which apply here), an arrest, or without informing the party of intent to turn those samples over to authorities, constitute illegal search and seizures. If my memory hasnt totally shit the bed on this the case is ACLU v. Reno? Maybe that was internets something.
sure they could turn it over to the cops. and then the DA will never prosecute you b/c they know even a PD half asleep and hungover will get the case dismissed in about 5 seconds.
Edit: ACLU v. Reno was internets something. I'll try to find the case because I remember learning it around the same time for some reason for some other principle.
