It isn't likely, but it is possible, based on the state where you live.
Also, one thing to keep in mind. If you fail the drug test and the company doesn't hire you, it is *very likely* that the company will put a note in your file saying that you are not to be hired if you ever apply at a future date. Similar to what happens if you are ever fired from a company.
Granted, not taking the test may earn you the same "do not hire" treatment, so it's likely that you've just blown your chances with that company. Permanently.
