| OSC should have done his research a little better before citing the Nancy Stouffer case as evidence of Rowling's own "borrowing" from other authors. Stouffer not only lost that case, but was forced to pay ~$2M in legal fees plus $50k in fines for submitting fraudulent documents. Basically, it was proven that her "The Legend of RAH and the Muggles" book was really just called RAH and they added in the rest of the title sometime after 1991; something to do with the ink used and the age of the printer. And that was just one example of things they altered to try to claim ownership.
The rest of his article was amusing though, I'll give him that. And I think that only #3 on his list of outcomes is particularly likely to happen. It seems unlikely that Fair Use is going to protect this guy. |
