Depends whether he was infringing on some copyright or trademark. If the domain name was something Blizzard has rights over (starcraft, worldofwarcraft, etc.) they probably could take it. Since Diablo is just a normal word though, I'm not sure.
There are a whole lot of things that come into play, but my guess he more or less gave it to them, maybe in return for something little on the side.
